Abstract

The author advises that guidelines concerning free speech rights of public employees that were formulated by General Counsel of the United States Civil Service Commission, Anthony Mondello, should be applied cautiously. The court decisions upon which the guidelines were based are analyzed and, in many cases, the author finds that the decisions don not support broad or generalized guidelines. It is still necessary to use a case-be-case approach when balancing the rights of governmental employees with the responsibilities of public employers.
