THE AMERICANS WITH DISABILITIES ACT'S IMPACT ON COLLECTIVE BARGAINING FOR TEACHERS

Abstract
This study explores the potential conflict between the spirit and letter of the Americans with Disabilities Act (ADA) and the spirit and letter of most collective bargaining agreements affecting public school teacher. Collective bargaining for public schools teachers provides a unique forum for investigating some of the possible unanticipated outcomes of ADA implementation. The law, its regulations for implementation, and the Equal Employment Opportunity Commission's Technical Assistance Manual on the Employment Provisions (Title I) of the Americans with Disabilities Act are cited and discussed in light of existing collective bargaining policies and practices and the logistical parameters likely to have an impact on the ADA's implementation in the public school setting.This work is licensed under a Creative Commons Attribution-Noncommercial-No Derivative Works 3.0 United States License.
