THE PERFORMANCE OF VOLUNTARY INTEREST ARBITRATION: THE CASE OF ISRAEL

Abstract

This article provides an analysis of the Israeli record of voluntary interest arbitration (VIA). The arbitration is assessed in terms of its performance, i.e., in terms of its durability, time delay, and its tendency of favor one party. The findings suggest high durability of VIA both in the private and public sectors. The different impact of private and public arbitrators on both time delays and award tendencies toward one party is also discussed. Even though the results are confined to Israel, they throw light on VIA - a relatively unresearched method for resolving interest disputes.
