THE CURRENT STATE OF THE NLRB'S DECISIONS FOR DEFERRAL TO ARBITRATION

Abstract
In 1973 and 1982, Fox et al. published two articles in this journal covering the deferral doctrine up to and including the Suburban Motor Freight case. This article reviews deferral doctrine development and discusses recent trends set forth by the Reagan-Majority NLRB through its decisions in Olin Corporation and United Technologies Corporation. Since public sector labor-management personnel often consider the system used in the private sector as a model, many local agencies and the federal government are beginning to use policies that allow deferrals to arbitrators' awards.This work is licensed under a Creative Commons Attribution-Noncommercial-No Derivative Works 3.0 United States License.
