EMERGING SIGNIFICANCE OF MANAGEMENT PREROGATIVES IN NEW JERSEY PUBLIC SECTOR: SCOPE OF NEGOTIATIONS

Abstract
The climate of public sector labor negotiations in New Jersey has been greatly altered by the Ridgefield Park decision of the State Supreme Court. The Court has held that Boards of Education do not have legislative approval to abdicate or bargain their managerial prerogatives in the realm of educational policy. The ruling limits the scope of negotiations and negates considerable contract language in existing public sector agreements. The author here examines the issue of management prerogatives as it relates to the Ridgefield Park decision.
