Abstract

Legislated final and binding arbitration of public sector impasses significantly weakens collective bargaining, while fact finding has been 95 percent effective in attaining negotiated agreements, author concludes. He presents a procedure to effectively improve the present collective bargaining environment, including mediation and fact finding. A final step offers the option of voluntary binding arbitration or the right to strike. A caveat to the parties in given - abdicate collective bargaining and private sector labor relations history will be repeated for the public sector.
