A COMPARATIVE ANALYSIS OF CANADIAN PUBLIC SERVICE LABOR RELATIONS STATUTES

Abstract

The author compares Canadian labor legislation dealing with public service employees who are employed directly by government departments (direct public employees) and those who are employed by government agencies, commissions, or corporations (public agency employees). The analysis deals with four aspects of the relevant statutes: the category of public employees covered, certification rights, bargaining rights, and permissible impasse procedures. Little uniformity was found among the jurisdictions, but a tendency was discerned for public sector legislation to conform to laws governing the private sector.
